Blue Sky Financial, LLC (“Blue Sky Financial,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains what information we collect when you visit blueskyfinancial.com or apply for a mortgage loan with us, how we use and share that information, and the choices available to you.

We are a licensed mortgage lender in California, Colorado, Idaho, and Washington. You can verify our license at NMLS Consumer Access.

1. Information We Collect

Information you give us directly

When you complete a form on our website, we collect:

  • Your first and last name
  • Your email address
  • Your mobile phone number
  • The ZIP code of the property you are inquiring about
  • Your loan purpose and, if you provide it, the loan amount you are seeking
  • Any information you type into a message or comment field
  • Your consent preferences, including whether you agreed to be contacted by phone, text, or email, and the date and time you did so

If you proceed to a full loan application, we collect the additional information required to evaluate and originate a mortgage loan. This typically includes your Social Security number, date of birth, income and employment information, assets and account balances, debts, and details about the property. This information is collected through our loan origination system and is governed by the federal Gramm-Leach-Bliley Act, described in Section 3 below.

Information we collect automatically

When you visit our website, we and our analytics and advertising providers automatically collect:

  • Your IP address, browser type, device type, and operating system
  • The pages you view, how long you stay, and the links you click
  • The website or advertisement that referred you to us
  • Advertising and campaign identifiers, including Google Click Identifiers (GCLID) and UTM campaign parameters, which let us understand which advertisements bring people to our site
  • Cookies and similar technologies, described in Section 5

Information we receive from others

If you apply for a loan, we receive information from consumer reporting agencies (credit bureaus), employers, financial institutions, appraisers, title companies, and others involved in the transaction, as necessary to process your application.

2. How We Use Your Information

We use the information we collect to:

  • Respond to your inquiry and contact you about mortgage products and services
  • Evaluate, process, underwrite, and service mortgage loans
  • Verify your identity and comply with federal and state lending, anti-money-laundering, and recordkeeping laws
  • Measure how our advertising performs and improve our website
  • Maintain a record of the consent you gave us to contact you
  • Detect and prevent fraud

We do not sell your personal information, and we do not share it with third parties for their own marketing purposes.

3. Financial Privacy Under the Gramm-Leach-Bliley Act

As a financial institution, our handling of the nonpublic personal information you give us in connection with a loan application is governed by the federal Gramm-Leach-Bliley Act (“GLBA”). The table below describes how we share that information.

We share information with service providers who perform functions on our behalf — including our customer relationship management system, our loan origination system, document providers, and our website and analytics vendors. These providers are permitted to use your information only to perform services for us.

We protect your personal information with physical, electronic, and procedural safeguards that comply with federal standards, and we limit access to employees who need it to do their jobs.

When you are no longer our customer, we continue to handle your information as described in this notice.

4. How We Contact You, and How to Stop

If you check the consent box on one of our forms, you are giving express written consent for us to contact you at the phone number and email address you provided — including by autodialed or prerecorded calls and SMS text messages — about mortgage products and services.

This consent is never a condition of applying for or receiving any loan, product, or service.

You can withdraw it at any time:

  • Text messages: reply STOP to any message. Reply HELP for help.
  • Phone calls: tell the caller to stop.
  • Email and everything else: email [email protected].

Message and data rates may apply. Message frequency varies. Withdrawing marketing consent does not stop communications we are required to send you about a loan you have applied for or that we service.

5. Cookies, Analytics, and Advertising

We use cookies and similar technologies to operate the site, remember your preferences, and measure performance. Specifically, we use:

  • Google Analytics to understand how visitors use our site
  • Google Tag Manager to manage those measurement tools
  • Google Ads to measure which advertisements lead to inquiries

These tools may set cookies and collect device and usage information. To measure which advertisements lead to inquiries, hashed (not plain) contact details submitted through forms may be transmitted to Google for that measurement, and are not used by Google to market to the visitor. You can control cookies through your browser settings, and you can opt out of Google Analytics using the Google Analytics Opt-out Browser Add-on. Blocking cookies may affect how parts of our site function.

Some browsers send a “Do Not Track” or Global Privacy Control signal. We honor the Global Privacy Control signal as an opt-out of the sale or sharing of personal information where applicable law requires it.

6. Your Privacy Choices

Regardless of where you live, you may:

  • Ask what personal information we hold about you
  • Ask us to correct information that is inaccurate
  • Ask us to delete information, subject to the records we are required by law to retain
  • Stop marketing contact at any time, as described in Section 4

Email [email protected] to make a request. We will verify your identity before acting on it. Note that mortgage lenders are required by federal and state law to retain loan records for a period of years, so we cannot always delete everything.

7. For California Residents

If you are a California resident, this section applies to you.

Much of the information we collect from loan applicants is subject to the Gramm-Leach-Bliley Act and is therefore exempt from the California Consumer Privacy Act (“CCPA”), as amended by the California Privacy Rights Act. Information we collect from website visitors who are not applying for a loan — such as the analytics and advertising information described in Section 5 — is not covered by that exemption.

We extend the following rights to California residents with respect to the personal information we hold about you:

  • Right to know. You may request the categories and specific pieces of personal information we have collected about you, the categories of sources, our purposes for collecting it, and the categories of third parties to whom we disclose it.
  • Right to delete. You may request that we delete personal information we collected from you, subject to legal retention requirements.
  • Right to correct. You may request that we correct inaccurate personal information.
  • Right to opt out of sale or sharing. We do not sell your personal information, and we do not share it for cross-context behavioral advertising as those terms are defined under California law.
  • Right to limit use of sensitive personal information. We use sensitive personal information only to provide the financial services you request and for purposes permitted without a right to limit.
  • Right to non-discrimination. We will not deny you services, charge you a different price, or provide you a different level of service because you exercised any of these rights.

Categories of personal information we have collected in the past 12 months: identifiers (name, email, phone, IP address); personal information under Cal. Civ. Code § 1798.80 (contact and financial information); commercial information (products and services inquired about); internet and network activity (browsing and interaction with our site); geolocation data (approximate, derived from IP address and property ZIP code); and, for loan applicants, financial and sensitive personal information necessary to underwrite a mortgage.

To exercise any of these rights, email [email protected]. You may designate an authorized agent to make a request on your behalf; we will ask for proof of that authorization. We will respond within the timeframes required by California law.

8. Data Security

We maintain physical, electronic, and procedural safeguards designed to protect your information, and we restrict access to those who need it to serve you. No method of transmission over the internet is completely secure, so we cannot guarantee absolute security. If you believe your information has been compromised, contact us immediately at [email protected].

9. Children

Our website and services are intended for adults. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us information, contact us and we will delete it.

10. Third-Party Websites

Our site links to websites we do not operate, including our online application portal and third-party review platforms. This Privacy Policy does not apply to those sites, and we are not responsible for their privacy practices. Review their policies before providing information.

11. Changes to This Policy

We may update this Privacy Policy. When we do, we will revise the “Last updated” date above and post the new version on this page. Material changes will be communicated as required by applicable law.
